1. Acceptance
These Terms of Service ("Terms") are a binding agreement between you and All You Can App, Inc. ("we," "us," "our") that governs your access to and use of our website, application, and related services (collectively, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. What the Service is — and what it is not
What it is
The Service is a productivity tool with integrated wellness-aware features, designed by neurodiverse people for use by adults with ADHD, autism, AuDHD, and other forms of neurological difference. It helps you organize projects, recognize your own state, and follow recovery actions you yourself have chosen in advance.
What it is not
The Service is not a mental health treatment tool, therapy platform, medical device, or clinical intervention system. Specifically:
- The Service does not diagnose any mental health, neurological, or medical condition.
- The Service does not provide therapy, counselling, or psychological treatment.
- The Service does not provide medical advice.
- The Service does not replace professional mental health support or any licensed clinician.
- All screening, check-in, and zone-classification prompts are educational and self-assessment only, not clinical assessments.
If you are experiencing a mental health crisis, stop using the Service and contact a human:
- 988 Suicide & Crisis Lifeline (US): call or text 988
- Crisis Text Line: text HOME to 741741
- Trevor Project, BlackLine, or other identity-specific lines
- Emergency: call 911 or your local emergency number
The Service surfaces these resources inside the product at any Stop-state ("maybe crisis") assessment. Doing so is part of the design; it does not make the Service a crisis-intervention service.
3. Eligibility
You must be 18 years of age or older to create an account or use the Service. By signing up, you represent and warrant that you are 18 or older. If we learn that you are under 18, we will terminate your account and delete associated data.
The Service is offered in the United States. You are responsible for compliance with any laws applicable in your location.
4. Your account
4.1 Waitlist (closed)
The Service is now generally available on the web — you can create an account directly at /sign-up. We previously operated a waitlist at /early while the Service was in pre-launch; that waitlist is now closed, and /early directs you to sign-up.
If you joined the waitlist while it was open, we recorded only your email, an optional first name and neurodivergent self-identification, and your consent to these Terms and our Privacy Policy at the moment you submitted the form. A waitlist entry did not create an account. You may request removal of any retained waitlist entry at any time by emailing support@allyoucan.app. See Privacy Policy Section 3.8 for what we store and Section 12 for your deletion rights.
4.2 Account requirements
- You must provide accurate registration information and keep your account secure (including your password).
- You are responsible for all activity that occurs under your account.
- You agree to notify us immediately at support@allyoucan.app of any unauthorized access or suspected breach.
- One account per person. You may not transfer your account to another person.
- We may suspend or terminate accounts that provide inaccurate registration information or violate these Terms (see Section 14).
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, or to encourage others to do so;
- Impersonate any person or misrepresent your affiliation with any person or entity;
- Post, transmit, or upload content that is unlawful, threatening, abusive, harassing, defamatory, hateful, obscene, or that infringes the intellectual property rights of others;
- Use the Service to harm minors;
- Attempt to gain unauthorized access to the Service, other accounts, or our systems (including by hacking, scraping, or circumventing rate limits or security controls);
- Use the Service to develop a competing product, including by copying or reverse-engineering significant portions of it;
- Use automated means (bots, scrapers, crawlers) to access the
Service except as permitted by our
robots.txtor with our prior written consent; - Resell, sublicense, or commercially exploit the Service without our prior written consent.
We may remove content or terminate accounts at our reasonable discretion when these rules are violated.
6. Subscription, billing, and refunds
The Service is offered on subscription tiers and one-time purchases
as described in our pricing page. Current tiers, prices, and refund
mechanics are summarized in PRICING.md and govern
purchases made through the Service.
6.1 Free trial
A 14-day free trial is available at sign-up. A valid payment method is required at sign-up. No charge is made during the trial. You may cancel any time before the trial ends to avoid being charged.
6.2 Pricing tiers
Base (web) pricing. See §6.2a below for platform-specific pricing when you purchase through the iOS App Store or Google Play.

6.2a Where you purchase, and platform pricing
You can subscribe through more than one channel: on the web at allyoucan.app, or — where our mobile app is available — as an in-app purchase through the iOS App Store or Google Play. The price shown to you is set for the channel you purchase through: web prices are set by us at checkout, and in-app prices are the prices displayed by the App Store or Google Play at the time of purchase. Prices may vary by platform and region. Current pricing is always shown at the point of purchase and on our pricing page.
Whoever you purchase through also bills you and handles that transaction: web purchases are billed by us (through Stripe); App Store purchases are billed by Apple; Google Play purchases are billed by Google.
Unified entitlement. Your subscription is honored across web and mobile — subscribing through any channel entitles you to the Service on every channel, and we do not bill you twice for the same subscription.
One-time purchases. The Calibration Burst and Annual Tune-up (the one-time AI-calibration add-ons described in §6.2) are currently available through the web. We may offer them through the iOS App Store and Google Play in the future.
6.2b Regional feature availability and platform differences
Your subscription pays for the core Service. Some features depend on third-party providers or platform capabilities that are not available in every region — for example, SMS notifications rely on carrier and messaging-provider coverage (Twilio), which at present covers U.S. and Canadian mobile numbers only and does not extend to every country. Where a feature is unavailable in your region, the remaining core features continue to work, and you can use an alternative channel where one exists (for example, email, in-app, push notifications, or Discord DM in place of SMS).
Pricing does not change based on which optional features are accessible to you. Subscription prices reflect the core Service. We do not raise, lower, or pro-rate your price based on whether a region-limited feature (such as SMS) happens to be available where you are. The absence of a region-limited feature is not grounds for a refund or price adjustment.
Web and mobile may differ. The web application and the mobile applications (iOS and Android) may vary in setup, layout, navigation, and available features. A feature may appear on one platform before another, may be presented differently, or may be available only on a particular platform due to platform requirements or technical constraints. Your subscription entitlement is unified across platforms (see §6.2a and the pricing page); the specific presentation and feature set on each platform may differ.
6.3 AI Calibration — free offer
Directors who subscribe to First Tier within their 14-day free trial receive a complimentary 14-day AI Calibration period beginning at day 15. This offer is available once per account. AI Calibration is opt-in — you choose when and whether to activate it.
6.4 Service usage limits
Some Service features carry per-use provider cost. The Service applies monthly limits to keep pricing predictable and to keep First-tier margins healthy. Email, in-app, and web-push notifications are uncapped on every tier; AI features and SMS notifications are subject to the limits below.
AI usage limits
AI features on Always-on AI ($29.99/month, $275.99/year) and on Calibration Bursts ($24.99 one-time, $39.99/year Annual Tune-up, and the free 14-day AI Calibration grant) include monthly limits on AI provider usage, measured in US dollars of provider spend (covering both language model and voice services; not token, character, or minute counts):

Soft limit (Always-on AI): When you exceed $15 of AI provider spend in a billing month, AI features gracefully reduce — multi-turn AI dialogues queue for the next day, certain composer responses fall back to a lower-cost model, and AI voice responses fall back to text-only. Rules-based features continue to work normally.
Hard limit: When you reach the hard limit (Always-on AI: $22/month; Calibration Burst: $15 per burst), AI features and AI voice responses pause for the remainder of the cycle. You receive in-product notice and AI resumes automatically at your next billing renewal or next burst activation. Rules-based features — including check-ins, zone routing, dashboard, and your toolkit — continue to work as normal.
Voice features and tier availability.
- Voice input (speech-to-text used within ALLY — the "Check in with AI" surface and the in-check-in ALLY chat), rendered through Deepgram Nova-3, is available on the Always-on AI tier and during Calibration Burst / Free Grant windows, alongside the other ALLY features.
- AI voice response (text-to-speech for AI-composed replies), rendered through OpenAI TTS-1, is available on Always-on AI (continuous) and on Calibration Burst / Free Grant windows. Voice response spend counts toward the AI usage limit shown above. First Tier directors receive AI responses as text only.
Live meter. Your current cycle's AI usage is shown in Settings → Subscription so the limit is visible at all times.
SMS notification limits
SMS reminders use a paid messaging provider (Twilio). Monthly SMS caps apply per director per billing cycle:

When the SMS cap is reached, additional SMS reminders are paused for the remainder of the cycle. You receive in-product notice. Email, in-app, and web-push reminders continue uninterrupted. Inbound replies (if any) do not count toward the cap. The cap resets at your next billing cycle.
Phone number and SMS consent. Phone number collection is optional and lazy — only collected when you first enable an SMS notification type. Before any SMS is sent, you must:
- Provide a phone number;
- Verify it via a one-time code; and
- Explicitly opt in to SMS notifications (TCPA compliance). Your opt-in timestamp and the consent text version are recorded.
Coverage. SMS notifications are currently available for U.S. and Canadian mobile numbers only. We may extend messaging to additional countries in the future (for example, via WhatsApp); any such change will be reflected in these Terms.
You may withdraw SMS consent at any time in Settings → Notifications or by replying STOP to any SMS message. Withdrawal stops all non-emergency SMS within 24 hours.
Live meter. Your current cycle's SMS usage is shown in Settings → Notifications.
These limits exist because the provider costs are usage-based on our side and we set them at levels that comfortably accommodate typical director use. We may adjust limits with 30 days' notice under Section 6.8 (Price changes); changes do not affect your current billing cycle.
Mobile push notifications (native)
If you install the mobile app and grant OS-level notification permission, we may send native push notifications through Apple's Push Notification service (APNs) and Google's Firebase Cloud Messaging (FCM). We use Expo Push as a delivery proxy — see Section 13. Push delivery is uncapped on every tier and is the preferred channel when you have granted permission. You may revoke notification permission at any time in your device settings.
Web browser push notifications
If you use the web app, you may opt in to browser push notifications via the Web Push standard (VAPID). Browser push requires a compatible browser and, on some platforms, an installable web app or granted permission per browsing session. Web browser push is uncapped on every tier. You may revoke browser push at any time by disabling notifications in your browser settings.
Notification types
Notifications you may receive (each independently on/off in Settings → Notifications) include:
- Reminders — routine reminders (block due soon), late-start reminders (block scheduled to start but hasn't), optional-dimension reminders (start-of-day nudge for optional dimensions you've turned on).
- Pattern warnings — boom-bust pacing warnings, chronic flare check-in reminders, experience-shift activation prompts, recharge- protocol prompts.
- Safety — always-on. Delivered to your wellness-buddy contact(s) (only, and only with your consent — see Section 7). You cannot disable safety notifications to yourself, but the Service will respect your quiet hours where appropriate.
- Product announcements — opt-in via Settings → Notifications → Product. When enabled, you receive an email when we publish a new update or feature to the community. Off by default.
- Repeat mode — for supported notification types, you may choose to have push/in-app reminders repeat every N minutes (5–120) until you dismiss them or the underlying event completes. Email and SMS reminders remain one-shot.
Calendar integration
Calendar integration (Google Calendar via OAuth, and / or universal iCal subscription feed for Apple Calendar / Outlook / others) is included on all tiers at no additional cost. By default, integration is push-only (the Service writes events to your calendar but does not read your calendar data). You may opt in to read access (free/busy windows for nudge scheduling, meeting context for the "Check in with AI" surface on Always-on AI) in Settings → Calendar. You may revoke calendar access at any time from the same place; revocation removes our access immediately and prevents future syncs.
We do not read calendar attendee names or email addresses, and we do not share your calendar data with third parties beyond the integration provider you authorized.
6.5 Auto-renewal
Monthly and annual subscriptions automatically renew at the end of each billing period using your payment method on file. You will receive a renewal reminder [X] days before renewal.
6.6 Cancellation
You may cancel your subscription at any time from Settings → Account → Subscription. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of the paid period.
6.7 Refunds
Monthly subscriptions. No refunds for the current billing month. Cancellation prevents future charges.
Annual subscriptions (First Tier $137.99, Always-on AI $275.99). If you cancel an annual subscription, you will receive a pro-rated refund for unused full months remaining at the standard single-tier monthly rate:
- First Tier: $14.99 / month used
- Always-on AI: $29.99 / month used
The annual discount is forfeit on early cancellation — you are charged the standard monthly rate for months used, not the effective annual rate.
Store-side purchases. Refunds on iOS App Store or Google Play purchases follow the store's own refund process (Apple: refund requests via reportaproblem.apple.com; Google: Play Store account order history). We can assist by providing purchase records but cannot issue refunds on your behalf for store- processed transactions.
Calibration Burst ($24.99 one-time). Full refund if requested within 7 days of purchase and AI Calibration has not been activated. Non-refundable once AI Calibration is activated.
Annual Tune-Up ($39.99). Pro-rated based on unused Calibration Bursts at $19.99 per unused burst.
Free trial. No charge — no refund applicable.
6.8 Price changes
We may change pricing with 30 days' notice. Price changes do not apply to your current subscription period. Continued use after notice constitutes acceptance of new pricing.
6.9 Payment processing
Web-side charges are processed by Stripe. You authorize us to charge the payment method you provide for the amounts disclosed at purchase, including renewals. Prices exclude any applicable taxes unless stated.
If in-app purchases through the iOS App Store or Google Play are enabled in the future, those transactions are processed by Apple Inc. or Google LLC respectively under their standard payment terms. Store-side purchase records, subscription management, and refund requests are handled through the respective store account.
6.10 Community access — Discord (optional, free to join)
We host a community server on Discord that is free for any director to join, whether you are subscribed, on a trial, or not subscribed at all. Public channels (welcome, announcements, general chat, tips, and other open spaces) are available to every member.
Active All You Can App paying-tier subscribers additionally receive a Discord role that unlocks subscriber-only channels (e.g. community events, body-double support, feedback, app help). Directors on the Always-on AI tier of All You Can App — or in an active Calibration Burst window — additionally receive an AI tier role that unlocks AI-specific channels. The Discord roles are tied to your All You Can App subscription, not to any Discord- side purchase, boost, or paid arrangement.
Roles are granted only after you voluntarily link your Discord account in Settings → Subscription. Linking is entirely optional — your access to the Service itself does not depend on having a Discord account, you may unlink at any time, and we will never require you to join Discord to use any feature of the Service.
When your subscription ends (cancellation, lapse past the grace period, or refund), the subscriber and AI tier roles are removed. Your Discord account remains in the public server unless you choose to leave; only the role-gated channels become unavailable.
Independence from Discord Inc. The community server is operated by us and is not a sale, sponsorship, partnership, endorsement, or other commercial arrangement involving Discord Inc. We are not affiliated with, owned by, or compensated by Discord Inc., and we do not sell access to Discord. The community is a voluntary support space that directors opt into on their own volition and at their own discretion. Your use of Discord is also subject to Discord's own Terms of Service and Community Guidelines, which we do not control.
6.11 Feedback surface
The Service includes an in-product feedback textarea on /announcements where you may submit informal comments about the Service. Feedback is transmitted to us by email (via Resend — see Section 13) with your account identity attached. Feedback is treated as non-confidential and we may act on it (fix bugs, ship features, change copy) without further obligation to you. We do not publish your feedback verbatim without your explicit permission and we do not share it with third parties beyond the email delivery provider. You may withdraw feedback by emailing support@allyoucan.app.
7. Your content and data
Ownership
You retain all rights to the content you create in the Service — your notes, check-ins, toolkit items, decision tools, project plans, zone profiles, support-contact list, and any other content you input ("Your Content").
Limited license to us
You grant us a non-exclusive, royalty-free, worldwide license to host, store, copy, transmit, display, and process Your Content only as necessary to operate, secure, troubleshoot, and improve the Service for you. This license ends when Your Content is deleted from our systems, except as required by law or for legitimate backup purposes for a limited time.
We do not acquire ownership of Your Content. We do not sell Your Content. We do not use Your Content to train third-party AI models. AI features available on certain tiers process Your Content only for the purpose of personalizing your experience and are subject to additional disclosures in product.
Your data rights (CCPA / GDPR-aligned)
The Service provides built-in tools, regardless of where you reside, to:
- Export your data: download a complete JSON export of your account at any time via Settings → Privacy & My Data.
- Delete your account: request soft-deletion via Settings → Privacy & My Data. After a 30-day window during which you can restore the account, the data is purged on the schedule described in our Privacy Policy.
US-based residents in jurisdictions with privacy statutes (including California under CCPA/CPRA) and residents subject to GDPR have additional rights described in the Privacy Policy.
7.4 Director alias for wellness buddies and body doubles
Your wellness-buddy contact list and body-double contact list may receive messages from the Service on your behalf (safety alerts, intro letters, plan-with-buddy requests). By default, we address you in those messages by the name in your account. You may set a per- contact alias — a name each contact knows you by — in Settings → Support Network. When set, that alias replaces your account name in every message the Service sends to that contact, including SMS, email, and Discord DM (where enabled). You may lock a single alias across all contacts. Aliases are the ONLY way director- provided context reaches non-directors; the Service never transmits your raw check-in text, project content, or other free-write content to a support contact — except the summary reports you choose to send (Section 7.6).
7.5 Immediate self-service deletion
In addition to the standard 30-day deletion flow in Section 7 and Section 14, the Service provides phrase-triggered paths for immediate account deletion and for immediate transition to a frozen offline copy of your data. Both paths require fresh consent, password re-entry, and explicit acknowledgement that deletion is irreversible and that no refund is issued for the current billing period — you waive the refund rights described in Section 6.7 by completing the flow. Distress-detection phrases short-circuit the trigger so it cannot fire during acute distress; crisis resources surface instead.
How to obtain these paths. The specific phrase triggers are not listed in this document to preserve their protective posture (they are intended to be memorable to you when you need them, not to be typed accidentally). If you would like to use one of these paths and cannot recall the phrase, email support@allyoucan.app with the subject line "phrase-triggered deletion" (for the immediate deletion path) or "phrase-triggered offline mode" (for the frozen offline-copy path). We will respond with the current phrase and confirm your identity before any action is taken.
7.6 Summary reports to your support contacts
You may choose to send a summary report to a wellness buddy or body double from Settings → Support Network. You control the level of detail (a tier you select) and which channels are used. A report is sent only to a contact who has accepted, and only on the channels they have consented to receive.
This is not clinical care. All You Can App is a productivity and wellness tool, not a medical or crisis service. When you send a report, you choose what to share and with whom. A wellness buddy or body double is a person you selected — they are not our employees or agents, and we do not control, monitor, or verify what they do with anything you share. You are responsible for what you send and to whom, and to the fullest extent permitted by law we are not liable for how a recipient uses, stores, discloses, or forwards a report you send. Only share what you are comfortable sharing. You can stop sending reports at any time in Settings → Support Network.
You may also set a default report type for a contact and turn on automatic sending rules so a report is delivered on your behalf when a condition you choose occurs — for example when the contact accepts the role, or when one of your check-ins reaches a Caution or Stop state. Automatic reports are subject to the same limits as a manual send: they go only to a contact who has accepted, only on the channels they have consented to, and they carry the content and detail tier you preset. You can change or turn off any rule at any time in Settings → Support Network, and the same responsibility and liability terms above apply to automatic reports.

8. Our intellectual property
We own all rights in the Service itself — the software, design, branding, name, logos, and trademarks. These Terms grant you a limited, personal, non-transferable, non-exclusive license to use the Service for your own use, subject to these Terms. Nothing here transfers ownership of the Service to you.
The "Four Quests" decision-clarity framework is authored by Anh Thien Ta and is used in the Service under license/attribution. The Four Quests, Nonviolent Communication, and Wellness Recovery Action Plan (WRAP) materials remain the property of their respective authors. The Service surfaces the canonical attribution wherever the framework appears.
9. Health and safety disclaimer (do not weaken)
You understand and agree that:
- The Service does not provide medical, psychological, or psychiatric advice.
- The Service's GO Zone / Caution / Stop classifications are based on your own self-report against the baseline you defined, and are not clinical diagnoses.
- Pattern-detection surfaces are educational, not diagnostic. The Service includes rule-based detectors that surface warnings and suggestions when your self-reported data over time matches certain patterns — including but not limited to boom-bust cycles (high-energy days followed by crashes), chronic-condition flare streaks, seasonal shifts, sensory episodes, and low-capacity / recharge-danger streaks. These detectors are educational reflections of what you already told the Service about yourself, offered so you can plan around them. They are not clinical assessments, they do not infer or claim any diagnosis, and they are not medical advice. The Service adopts an explicit posture of never naming a neurodivergence or clinical condition that you have not shared with it.
- The Service does not guarantee any outcome. Productivity, wellness, mood, or symptom improvements are dependent on you, your circumstances, and your engagement.
- You are solely responsible for decisions you make, including in relation to your mental health.
- If you are in crisis or believe you may be a danger to yourself or others, you will contact emergency services or a crisis hotline immediately, not the Service or our team.
- You will obtain professional medical or psychological advice for any medical or psychological concern. The Service is not a substitute for that advice.
- If you are currently in treatment, you will discuss any wellness tools (including this one) with your treating clinician.
- The Service is not for use during acute psychiatric crisis, active suicidal ideation, or for the treatment of diagnosed conditions including but not limited to PTSD, bipolar disorder, schizophrenia, or substance-use disorders.
10. Disclaimers ("AS IS")
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, OR ACCURACY. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use the Service at your own risk.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunity, even if advised of the possibility.
- Our total aggregate liability to you for any claim arising out of or relating to the Service or these Terms is limited to the greater of (a) the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).
- These limits apply regardless of the legal theory (contract, tort, strict liability, or otherwise) and survive termination of these Terms.
Some jurisdictions do not allow exclusion of certain warranties or limitations of liability; in those jurisdictions our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to defend, indemnify, and hold harmless All You Can App, Inc., its officers, directors, employees, agents, contractors, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service;
- Your violation of these Terms;
- Your violation of any rights of another person or entity, including intellectual property or privacy rights;
- Your Content.
We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, at your expense.
13. Third-party services
The Service relies on third-party providers including but not limited to Supabase (data storage, authentication), Vercel (hosting), Stripe (payments), Resend (transactional email), Twilio (SMS notifications on all tiers, subject to per-tier caps), Anthropic (language-model AI features on Always-on AI / Calibration Burst tiers), Deepgram Nova-3 (voice input / speech-to-text within ALLY, on Always-on AI / Calibration Burst tiers), OpenAI TTS-1 (text-to-speech for AI voice responses on Always-on AI / Calibration Burst tiers), Google LLC (Google Calendar API, only when you authorize calendar integration), Expo (Expo Application Services; delivery proxy for native mobile push notifications, which then flow onward to Apple Push Notification service (APNs) for iOS and to Google Firebase Cloud Messaging (FCM) for Android — only when you have installed the mobile app and granted OS-level notification permission), and Discord Inc. (community server hosting, only when you voluntarily link your Discord account — see Section 6.10 for the full optional-community terms; we are not affiliated with, sponsored by, or selling access to Discord). Your use of the Service is subject to those providers' terms and privacy practices in addition to ours. We are not responsible for third-party services beyond integrating them responsibly.
iCal subscription clients. In addition to the providers above, if
you choose to subscribe to the Service's universal iCal feed (at
/api/calendar/feed/{token}.ics), you do so through a third-party
calendar client or application of your choice — for example, Apple
Calendar, Microsoft Outlook, Fastmail, Google Calendar (via its URL
subscription mechanism), or any other RFC 5545 compliant calendar
application. The Service publishes the feed; the calendar application
you use to subscribe is operated by its own vendor under its own
terms and privacy practices. We do not integrate with those
applications directly, we do not receive data back from them, and
your feed URL functions as an unguessable per-account token that you
may rotate or disable at any time in Settings → Calendar.
14. Termination
We may suspend or terminate your account if:
- You materially violate these Terms;
- Your registration information is inaccurate;
- We are required to do so by law;
- We discontinue the Service.
You may terminate your account at any time via Settings → Privacy & My Data. On termination:
- Your access to paid features ends per Section 6;
- A 30-day grace period applies before soft-deletion, during which you can restore the account;
- Your Content is purged on the schedule described in the Privacy Policy, except where retention is required by law or for legitimate business purposes (e.g. payment records).
Sections that by their nature should survive termination — including Sections 7 (Content), 8 (IP), 9 (Health Disclaimer), 10 (Disclaimers), 11 (Liability), 12 (Indemnification), 16 (Governing Law), and 17 (Dispute Resolution) — survive termination.
15. Changes to the Service or these Terms
We may change the Service at any time. We may change these Terms by posting an updated version inside the Service and updating the "Last updated" date. If we make material changes, we will provide reasonable advance notice (at least 30 days for changes that materially reduce your rights), via email or in-product. Your continued use after changes take effect constitutes acceptance.
16. Governing law
All You Can App, Inc. is a corporation incorporated under the laws of the State of Delaware (a Delaware C corporation) and is registered to conduct operations and do business in the State of California, where its principal place of business is located.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
17. Dispute resolution — binding arbitration; class action waiver
PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by JAMS under its applicable rules, held in San Francisco, California (or remotely if both parties agree). The arbitrator's decision is final and binding.
Class action and jury trial waiver. You and we each waive any right to a jury trial and to participate as a plaintiff or class member in any class, collective, or representative action.
One-year limitation. Any claim must be brought within one (1) year after the cause of action arose, or it is permanently barred.
Exceptions. Either party may bring an individual action in small-claims court, and either party may seek injunctive relief in any court of competent jurisdiction for actual or threatened infringement of intellectual property rights or unauthorized access to the Service.
Opt-out. You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing support@allyoucan.app with "Arbitration Opt-Out" in the subject line and your full name and account email in the body.
18. Miscellaneous
- Entire agreement. These Terms (with the Privacy Policy) are the entire agreement between you and us regarding the Service.
- Severability. If any provision is found unenforceable, the rest remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms. We may assign to an affiliate or successor.
- No agency. Nothing here creates a partnership, joint venture, employment, or agency relationship.
- Notices. We send notices to your registered email. You send notices to admin@allyoucan.app.
